The editor of this website (the “site”) is the company PHARMALAB (“PHARMALAB”), a Société par Actions Simplifiée (a simplified joint stock company) with a capital of 4,000,000 Euros, registered with the Paris Company Register under the number 339 211 708, and located at 1, bis rue du Havre 75008 Paris. The telephone number is 0033 (0)1 55 30 60 72.
 
The publication manager is Guillaume PERRUCHOT. The head pharmacist is Mrs. Bénédicte COLLET.
 
The website host is the company NUMEEZY, which is an Internet based referencing and web marketing agency for the Nancy-Lorraine area. 

 

2.Subject 

 
These general terms and conditions regulate the use of the website (“General Terms and Conditions of Use). The user accepts them upon accessing the website. Otherwise he is requested to leave..
 
The objective of the site is to provide (i) users with information relating to the company PHARMALAB and (ii) pharmacist exclusively with information relating to health products sold by PHARMALAB, in particular the product price catalogues distributed by PHARMALAB.
 
 
Considered as a “pharmacist” is any active physical person who has a pharmacist’s diploma, proving his registration to a section of the Order of Pharmacists.
 
Considered as a “user” is any physical person accessing information provided by the site, whether they are a pharmacist or not.

 

3.Data Protection

 
In order that the pharmacists may access certain parts of the website, the input of a CIPN code is required. This input, which is not saved, is not obligatory. Its objective is to allow only pharmacists to access parts of the site with specific and regulated information intended for them. If they do not subscribe, they will not be able to access this information.
 

The personal information collected by means of the form is intended for PHARMALAB. It will not be communicated to third parties in any case, unless otherwise specified on the form.
This information is saved confidentially for a duration of one (1) year.

 
In accordance with modified French law no 78-17 from 6th January 1978 relating to computing, files and liberties, the pharmacist possesses the right to access, modify, rectify and oppose the retaining of information relating to him.

In accordance with the aforementioned law from 6th January 1978, the handling of nominative information collected on the site is the subject of a declaration made before the French National Commission on Informatics and Liberties.
 
When visiting the site, a cookie may be installed automatically on the navigation software. The cookie is a data block which does not enable the identification of users but serves to record information relating to the users’ navigation around this site. The programming of the navigation software can inform you of the presence of the cookies and allows you to refuse them.

 

4.Protection of Intellectual Property Rights

 
The texts, images, maps and logos present on this site are the property of PHARMALAB, WELCOOP or the companies of the group, or they have been permitted under the  Fotoliain particular the photograph on the homepage (Pharmacy chemist woman in drugstore). . They may not be shown or reproduced without written consent, except as part or strict private or non-commercial use.
 
Failure to respect this obligation constitutes a counterfeiting offence which is criminally sanctioned.
 

5.Access modalities

 
Access to the site is possible 7 days a week, 24 hours a day, holiday days included, except in the case of force majeure or in the event of something which is out of the control of PHARMALAB, and subject to potential breakdowns and maintenance work necessary for the correct functioning of the service and materials.
 
PHARMALAB reserves (i) the right to interrupt all or part of the site without this enabling the right to any indemnification, (ii) the right to modify these schedules and dates under the condition that the user is informed of these at least 5 days in advance via an “online” message, and (iii) the right to modify the service in terms of form as well as content, without any duty to inform the user beforehand.
 
PHARMALAB grants users, who agree, the right to connect a micro-computer of their choice to the site services.
 
Access to certain services is subject to registration and use of a username and password. The username and password are strictly personal and confidential. The pharmacist can change his password at any time. He commits himself to not reveal his password to any third party.
 
In the case of the loss or theft of the username or password, the pharmacist must inform PHARMALAB within 24 hours of the loss or theft.  PHARMALAB will then immediately delete the elements in question and will send the new identification elements to the pharmacist by email.

 

6.Responsibility

 
PHARMALAB gives no guarantee as regards the exactitude of the information given on the site or the other websites to which you may be forwarded via hyperlinks. Likewise, the opinion of possible experts given on the site pages or on third party sites is not to be interpreted as necessarily representing the stance of PHARMALAB.
  
PHARMALAB guarantees (i) that it has implemented and (ii) that it will implement all means in order that the user has reliable and up-to-date information and databases by means of the website. However, PHARMALAB will not be held responsible for errors, omissions, fault of any nature or lack of updates.
  
PHARMALAB can carry out modifications to the web pages at any time; it will not be held responsible for any reason or on any basis for damages resulting, directly or indirectly, from the use of the site or information available online, in particular in the case of the occurrence of a computer virus.
 
The user is the sole person responsible for any prejudice, direct or indirect, material or immaterial, brought by himself against PHARMALAB or third parties through his use of the site.
 
PHARMALAB will not be held responsible in the event of force majeure or events outside of its control, in particular in the event of an interruption to the access or accessible networks by the site, or of the failure of the receiver equipment or the user’s line, or the loss of information or any transaction made by means of the site.
  
PHARMALAB is free of responsibility in the event of use of the site which does not conform with these General Terms and Conditions.
 
The pharmacists are the sole people responsible for the use of usernames and passwords necessary upon registration to the site. All access to the site using pharmacist usernames and passwords will be deemed to have been carried out by said pharmacist.
 
In no case will PHARMALAB be responsible (i) for faults, carelessness, voluntarily or involuntarily committed by the user, (ii) for the reliability of the information transmission, (iii) for access times and possible access restrictions, (iv) for compatibilities and reliability of software, (v) due to errors, faults of any nature, omissions or even lack of database updating, (vi) due to faults or carelessness of the pharmacist, voluntary or involuntary, allowing a third party to access the controlled market for distribution of medication between suppliers.  

 

7.Confidentiality

 
The user is committed to keeping the information provided by PHARMALAB strictly confidential unless he has been explicitly authorised to transmit it.
 
PHARMALAB commits itself to not divulge to anyone information regarding the nature or subject of orders, consultations or transactions addressed to PHARMALAB by the users.
 
PHARMALAB cannot guarantee the secrecy of messages sent via the internet. As these can be intercepted on the network, their confidentiality cannot be guaranteed until they have crossed the network.  

 

8.No Waiver

 
The fact that PHARMALAB does not exercise one of the provisions of these General Terms and Conditions of Use at a given moment, cannot be interpreted as a waiver of the right to exercise one of these Conditions at a later date.

 

09.Validity of the General Terms and Conditions of Use

 
If one of the clauses of these General Terms and Conditions of Use should be rendered void or ineffective, the other clauses  of these General Terms and Conditions of Use remain in effect, unless the invalid obligation is an essential obligation whose deletion or cancellation inhibits the implementing of these General Terms and Conditions of Use as a whole.  

 

10.Other information 

 
The Site and the General Terms and Conditions of Use are under French law and any disagreement will fall within Parisian jurisdiction.
